GENERAL
This website, www.theavoshop.co.nz, is owned and operated by Viking Orchard Ltd, a New Zealand-based company. By using The Avo Shop, you acknowledge that you have read, understood, and agreed to these terms and conditions. All purchases of fruit and other products from The Avo Shop are subject to these terms and conditions, and The Avo Shop reserves the right to modify them at any time. The Avo Shop also reserves the right to decline or cancel any order for any reason. You are responsible for all orders placed under your login. While The Avo Shop strives to provide accurate information on its website, it makes no warranties regarding the accuracy or completeness of the information. The Avo Shop shall not be held liable for any errors or omissions. Please note that product photos are for representation purposes, and there may be variations within a variety.

PRICE
Customers will be charged the displayed price on the website at the time of order submission, along with any applicable shipping costs, for the fruit ordered from The Avo Shop. Prices for one-off boxes and subscriptions may fluctuate due to the seasonal nature of the produce. Shipping costs are determined by location. If a customer selects an incorrect shipping option, The Avo Shop reserves the right to refuse or cancel the order or charge any additional shipping costs. The customer will be notified if there are any additional delivery charges. All prices for fruit and shipping costs are in New Zealand currency. If The Avo Shop is unable to supply the ordered fruit, the customer will receive a refund or a similar alternative upon approval.

QUALITY
The customer acknowledges that The Avo Shop sells perishable goods. The Avo Shop may, at its discretion, replace any damaged fruit or provide a refund if the customer reports the damage within 48 hours of receiving the fruit. The customer may be required to provide a photo of the damaged fruit before receiving a refund or replacement. The Avo Shop shall not be liable for damage to fruit resulting from incorrect storage or mishandling after delivery.

PAYMENT
Customers must pay for the fruit purchased either through internet banking or by credit card before their order is dispatched. Customers are responsible for all costs associated with debt collection. The Avo Shop does not store any customer credit card details. All credit card transactions are securely processed by Direct Payment Solutions (DPS), the company used by The Avo Shop for credit card transactions. Customers with a The Avo Shop account and invoice billing must pay by the stated due date. The Avo Shop will charge 3% interest per month and debt collection charges for any accounts not paid by the due date.

DELIVERY
The Avo Shop reserves the right to withhold the delivery of any product for any reason. Deliveries will be made to the address specified by the customer during the order placement. Once the fruit is left at the designated address, it will be considered delivered. The customer must ensure that The Avo Shop or its agent can deliver to the instructed location. The Avo Shop aims to dispatch all orders within six working days. If a customer has not received an order within seven days of placing it, they should contact The Avo Shop. If the customer receives an incorrect order, they must notify The Avo Shop within 24 hours of receipt; failure to do so will be deemed acceptance of the delivered fruit. If the customer contacts The Avo Shop within 24 hours, arrangements will be made for a replacement of the correct fruit if available. The Avo Shop does not offer refunds for change of mind.

LIABILITY AND INDEMNITY
The Avo Shop shall not be liable for any loss, damage, or injury arising directly or indirectly from the fruit. The Avo Shop shall not be liable for any consequential injury or loss resulting from the customer’s use of The Avo Shop or the delivery or non-delivery of fruit. By using The Avo Shop site or receiving product delivery, the customer agrees to indemnify The Avo Shop against all liabilities, losses, claims, and expenses arising directly or indirectly from their use of the site or the delivery or non-delivery of any product.

USE OF COOKIES
The Avo Shop uses Google Analytics cookies to collect information about visitor usage of the site. The information is used to compile reports and improve the site. These cookies collect information in an anonymous form, including the number of visitors, their source, and the pages visited.
